Jimmy Ray Mathews a/k/a Jimmy Ray MATTHEWS, Appellant v. The STATE of Texas, Appellee
From the Criminal District Court 1, Tarrant County, Texas
Trial Court No. 1249644d
The Honorable Sharen Wilson, Judge Presiding
ORDER
Appellant's court-appointed attorney filed an Anders brief in this appeal, asserting there are no meritorious issues to raise on appeal. See Anders v. California, 386 U.S. 738 (1967). Counsel advised appellant of his right to review the record and file his own brief. Appellant has asserted his right to file a brief by filing a motion to extend time to file his pro se brief, citing as the reason for extension that he has not had access to the appellate record.
Accordingly, we ORDER the Tarrant County District Clerk to prepare and send full and complete duplicate copies of the clerk's and reporter's records for Cause No. 1249644d to appellant Jimmy Ray Mathews a/k/a Jimmy Ray Matthews, TDJC #01798365, H.H. Coffield Unit, 2661 FM 2054, Tennessee Colony, Texas 75884. The Tarrant County District Clerk is further ORDERED to file written proof in this court showing the date that a copy of the record was sent to appellant. Such proof shall be filed in this court on or before May 13, 2013..
It is further ORDERED that appellant's motion for extension of time to file the pro se brief is GRANTED IN PART AND DENIED IN PART. Appellant's pro se brief is due in this court on or before June 17, 2013. If appellant files a pro se brief, the State may file a responsive brief no later than thirty days after the date appellant's pro se brief is filed.
We ORDER the clerk of this court to serve a copy of this order on the pro se appellant, all counsel, and the Tarrant County District Clerk.
