Dustin Matthews, Plaintiff, v. City of Tempe, et al., Defendants.

ORDER

HONORABLE STEVEN P. LOGAN, DISTRICT JUDGE

Before the Court is Defendants' Motion to Supplement (Doc. 86) in which Defendants seek to supplement their pending Motion for Reconsideration (Doc. 81) with three documents. Specifically, Defendants seek to submit an Affidavit of Non-Appearance and invoices from the court reporter and from the videographer who appeared for the September 15, 2022 deposition of Plaintiff that is at issue in Defendants' Motion for Reconsideration.

Plaintiff did not respond to or otherwise oppose Defendants' Motion to Supplement. Pursuant to LRCiv 7.2(i), the Court deems Plaintiff's failure to respond as consent to the granting of Defendants' Motion. Therefore, the Court grants Defendants' Motion to Supplement and will consider the documents attached to the Motion in ruling on Defendants' Motion for Reconsideration.

Accordingly,

IT IS ORDERED that Defendants' Motion to Supplement (Doc. 86) is granted. The Court will consider the Exhibits attached to Defendants' Motion (Docs. 86-1, 86-2 & 86-3) in ruling on Defendants' Motion for Reconsideration.
