Opinion
March 16, 1949.
Appeal from Workmen's Compensation Board.
Present — Foster, P.J., Heffernan, Brewster, Deyo and Santry, JJ.
The findings as to occurrence of accident, injury and causal connection are supported by evidence. The record discloses proper basis for the board's excuse of claimant's failure to file his claim within thirty days from date of accident. ( Matter of Haug v. Pfortsch, 266 App. Div. 705, motion for leave to appeal denied 290 N.Y. 931; Matter of Stemman v. Roosevelt Hotel, 272 App. Div. 853, affd. 297 N.Y. 655.) Decision and award unanimously affirmed, with costs to the Workmen's Compensation Board.
