Claim of Zona v. Seneca Knitting Mills, Inc.

Appellate Division of the Supreme Court of New York, Third Department
Jan 13, 1943
265 App. Div. 1021 (N.Y. App. Div. 1943)

Opinion

January 13, 1943.

Present — Hill, P.J., Crapser, Bliss, Heffernan and Schenck, JJ.

The employer and its insurance carrier have appealed from an award in claimant's favor for $100 for serious facial disfigurement. It is conceded that claimant was injured in the course of his employment and sustained a deep cut above his left eye. The medical testimony shows that the scar is noticeable and that the condition is permanent. A question of fact, and not of law, only is involved. Award unanimously affirmed, with costs to the State Industrial Board.
