Proceeding under article 78 of the Civil Practice Act, to annul the determination of the Commissioner of Motor Vehicles of the State of New York, which revoked petitioner's license to operate a motor vehicle, for a violation of paragraph (e) of subdivision 3 of section 510 Veh. Traf. of the Vehicle and Traffic Law. By order of the Supreme Court, Westchester County, dated December 8, 1961, the proceeding has been transferred to this court for disposition (Civ. Prac. Act, § 1296). Proceeding dismissed and determination confirmed, without costs. No opinion. Beldock, P.J., Ughetta, Kleinfeld, Christ and Hopkins, JJ., concur.
