Matter of Vergari v. Hirniak

Court of Appeals of the State of New York
Nov 21, 1977
372 N.E.2d 333 (N.Y. 1977)

Opinion

Decided November 21, 1977

Appeal dismissed, without costs, by the Court of Appeals sua sponte, upon the ground that the order sought to be appealed from does not finally determine the proceeding within the meaning of the Constitution (see Lizza Inds. v Long Is. Light. Co., 36 N.Y.2d 754; Walker v Sears, Roebuck Co., 36 N.Y.2d 695).
