Decree of the Surrogate's Court, Queens County, admitting to probate an instrument in writing as the will of the decedent, directing the issuance of letters testamentary to the executor therein named upon his qualifying, and awarding to the respondent costs payable out of the estate, unanimously affirmed, with costs to the respondent, payable by the appellant personally. No opinion.
