Claim of Sullivan v. Rochester Smelting & Refining Co.

Appellate Division of the Supreme Court of New York, Third Department
Sep 29, 1937
252 App. Div. 712 (N.Y. App. Div. 1937)

Opinion

September 29, 1937.

The award is for lead poisoning. The evidence sustains the award. Award affirmed, with costs to the State Industrial Board. Hill, P.J., Rhodes, McNamee and Heffernan, JJ., concur; Crapser, J., dissents, and votes to reverse, on the ground that the disability shown by the proof is confined to a particular industry; that does not justify an award.
