Opinion
December 30, 1942.
Present — Lazansky, P.J., Hagarty, Johnston, Taylor and Close, JJ.
Motion for a stay denied, without costs. The order is not appealable. ( Matter of Kempf, 243 App. Div. 855.) Therefore, on the court's own motion, the appeal is dismissed, without costs, and without prejudice to appellants moving before the Surrogate to open their default and to grant them a reasonable time to complete the examination and file objections.
