Matter of Sonnenberg

Appellate Division of the Supreme Court of New York, Third Department
Dec 20, 1961
15 A.D.2d 606 (N.Y. App. Div. 1961)

Opinion

December 20, 1961

Present — Bergan, P.J., Coon, Gibson, Herlihy and Reynolds, JJ.

Appeal by claimant from so much of a decision of the Unemployment Insurance Appeal Board as held that claimant, for the eight years then last past a stock control clerk in a Federal agency, was disqualified from receiving benefits by reason of her refusal, without good cause, of re-employment in a position of the same grade with the same agency. The sole issue presented is that as to the alleged refusal, claimant contending that no offer of employment was ever made. The board expressly found that the "credible evidence" was to the contrary. The determination of credibility was within the province of the board and we are without power to disturb it. Decision affirmed, without costs.
