DISCIPLINARY MATTERS
ORDER
ROGER E. SMYZER of Parlin having appeared before this Court on the return date of an order to show cause why he should not be temporarily suspended from the practice of law and why the Division of Ethics and Professional Services should not be empowered to take appropriate action to gain possession and control of the respondent's files and records, and this Court having duly considered the arguments of counsel, and good cause appearing;
It is ORDERED that ROGER E. SMYZER be and hereby is temporarily suspended from the practice of law pending final disposition of the ethics charges against him, effective immediately, and until further order of this Court; and it is further
ORDERED that the Division of Ethics and Professional Services take appropriate action to gain possession and control of the legal files and records of ROGER E. SMYZER wherever situate pursuant to R. 1:20-5(b); and it is further
ORDERED that all funds presently existing in any New Jersey banking institution including but not limited to the Perth Amboy National Bank, Convery Boulevard and Brace Avenue, Perth Amboy account # 014-0821-3 and the National Community Bank of New Jersey, East Hanover, New Jersey, trust account # 1973-298-4 maintained by ROGER E. SMYZER, pursuant to R. 1:21-6, relating to his law practice shall not be disbursed except upon application to this Court, for good cause shown, pending the further order of this Court; and it is further
ORDERED that said ROGER E. SMYZER is hereby restrained and enjoined from practicing law during the period of his suspension; and it is further
ORDERED that respondent comply with all the regulations of the Disciplinary Review Board governing suspended, disbarred or resigned attorneys.
