Opinion

November 28, 1950.

Present — Peck, P.J., Glennon, Dore, Van Voorhis and Shientag, JJ.;

Under the unusual circumstances in this case, we think plaintiff's motion should have been granted to the extent of directing payment to him of $200 for services and disbursements. Order reversed, with $20 costs and disbursements, and the motion granted to the extent set forth herein.

Dore, J., dissents and votes to affirm. Settle order on notice.
