Matter of Slovack

Appellate Division of the Supreme Court of New York, Third Department
Nov 22, 1967
28 A.D.2d 1185 (N.Y. App. Div. 1967)

Opinion

November 22, 1967

Appeal by the claimant from a decision of the Unemployment Insurance Appeal Board which denied benefits on the ground that the claimant had not established the number of required weeks during the base period. The record contains substantial evidence to support the board's finding that Les Larry Elgart Orchestra, Inc., was not the employer of the claimant and that under the circumstances the claimant had accumulated a total of 16 weeks during the base period when the statute requires at least 20 weeks of covered employment. Under the circumstances we reach no other issues. Decision affirmed, without costs. Gibson, P.J., Herlihy, Reynolds, Aulisi and Staley, Jr., JJ., concur in memorandum by Herlihy, J.
