Matter of Santiago v. City of New York

Appellate Division of the Supreme Court of New York, First Department
Sep 14, 1995
219 A.D.2d 493 (N.Y. App. Div. 1995)

Opinion

September 14, 1995

Appeal from the Supreme Court, Bronx County (Douglas McKeon, J.).

In light of the failure to adequately explain the delay and the absence of actual notice to respondents, the court's denial of petitioner's application was not an abuse of discretion.

Concur — Sullivan, J.P., Ellerin, Wallach, Williams and Mazzarelli, JJ.
