Opinion
January 18, 1950.
Appeal from Workmen's Compensation Board.
Present — Foster, P.J., Heffernan, Brewster, Bergan and Coon, JJ.
Applicable presumptions and competent evidence support the board's finding that the unwitnessed accident, which occasioned the death of the decedent, arose out of and in the course of his employment. Decision and award unanimously affirmed, with costs to the Workmen's Compensation Board.
