In a proceeding pending in the County Court, Suffolk County, under section 330 of the Election Law, to enjoin respondents, candidates for public office, from using the name "Republican" in their literature and advertising sponsoring their candidacy, the respondents move in this court to vacate a temporary stay against them granted ex parte in a show cause order, issued October 21, 1961, by the County Judge. Motion dismissed as academic. It appears that the County Court has since rendered its decision, after a hearing, determining the proceeding on the merits. Beldock, Acting P.J., Ughetta, Kleinfeld, Christ and Pette, JJ., concur.
