Motion for permission to proceed as a poor person and assignment of counsel upon appeal from order denying application for order to show cause denied, on the ground that such order is not appealable as of right (CPLR 5701). Gibson, P.J., Reynolds, Aulisi, Staley, Jr., and Gabrielli, JJ., concur.
