Hill ( ante, p. 735), decided herewith. Hagarty, Scudder, Tompkins and Davis, JJ., concur; Lazansky, P.J., votes for reversal and denial of the motion for the reasons stated in his dissenting memorandum ( ante, p. 735) decided herewith.
