Matter of Pavel v. Alinda

Appellate Division of the Supreme Court of New York, Second Department
Dec 27, 1994
210 A.D.2d 477 (N.Y. App. Div. 1994)

Opinion

December 27, 1994

Appeal from the Family Court, Kings County (Pearce, J.).

Ordered that the order is affirmed, without costs and disbursements.

The Family Court properly dismissed the proceeding without a hearing, because the blood tests conclusively excluded the possibility of paternity and the authenticity of the test results was not challenged (see, Matter of Thomas F. v Victoria G., 194 A.D.2d 670). Bracken, J.P., Balletta, Ritter, Pizzuto and Florio, JJ., concur.
