Matter of Pafundi v. Allen

Court of Appeals of the State of New York
Oct 1, 1964
202 N.E.2d 379 (N.Y. 1964)

Opinion

Submitted September 28, 1964

Decided October 1, 1964

Motion to amend remittiturs granted. Return of remittiturs requested and, when returned, they will each be amended by adding thereto the following: Petitioner contended that section 7126 of the Education Law violates the Fourteenth Amendment to the United States Constitution in that it (1) creates an arbitrary distinction between optometrists and ophthalmic dispensers, (2) deprives petitioner of property without due process of law, and (3) denies him the equal protection of the laws. The Court of Appeals, passing upon these contentions, held that there was no violation of petitioner's constitutional rights.
