Matter of Ortiz v. Supreme Ct. of N.Y. Cty

Appellate Division of the Supreme Court of New York, First Department
Dec 21, 1993
199 A.D.2d 160 (N.Y. App. Div. 1993)

Opinion

December 21, 1993

The proceeding must be dismissed since neither the Police Department nor the Supreme Court are the custodians of the records sought to be corrected. Rather the New York State Division of Criminal Justice Services is the agency charged with the responsibility of maintaining criminal records.

Concur — Rosenberger, J.P., Ross, Asch and Rubin, JJ.
