(244 App. Div. 496, affd. 268 N.Y. 688) the Court of Appeals confirmed the grant of an injunction for "illegality" pursuant to section 123 where the competing store was within 1,500 feet of the proposed licensee, contrary to the provisions of subdivision 4 of section 105 Alco. Bev. Cont. of the Alcoholic Beverage Control Law.
