In a proceeding pursuant to section 259 of the Surrogate's Court Act, by the Commissioner of Hospitals of the City of New York, as a creditor of decedent, to compel the decedent's executrix to judicially settle her account, the executrix appeals from an order of the Surrogate's Court, Nassau County, dated December 27, 1960, directing her to file her account. Order affirmed, with $10 costs and disbursements. No opinion. The time of the executrix to file her account, as directed by the order, is extended until 30 days after entry of the order hereon. Beldock, Acting P.J., Ughetta, Christ, Pette and Brennan, JJ., concur. [ 27 Misc.2d 431.]
