Matter of Nathanson v. Ignaz Strauss Co., Inc.

Appellate Division of the Supreme Court of New York, Third Department
Jan 13, 1943
265 App. Div. 1027 (N.Y. App. Div. 1943)

Opinion

January 13, 1943.

Appeal from State Industrial Board.

Present — Hill, P.J., Crapser, Bliss, Heffernan and Schenck, JJ.

On the day claimant sustained the injuries which resulted in his disablement he was employed as a packer. The State Industrial Board found that he was disabled while lifting two cases weighing about 200 pounds each; that the moving of these packing cases was unusual and not a part of his ordinary and regular work, and that his resultant condition was due to the unusual exertion. There is ample evidence to sustain the finding of the Board, and the award should be affirmed. Award unanimously affirmed, with costs to the State Industrial Board and printing disbursements to the attorney for claimant.
