Matter of Moriniti v. Peter A. Lobello

Appellate Division of the Supreme Court of New York, Third Department
Apr 19, 1971
36 A.D.2d 868 (N.Y. App. Div. 1971)

Opinion

April 19, 1971

Appeals from a decision of the Workmen's Compensation Board, filed April 1, 1970, which found that the Peter A. Lobello Pipe Line Corporation was decedent's general employer, that Capp Excavating Company and Savin Brothers, Inc., were decedent's joint special employers and that each of said employers was one third liable for compensation. There was substantial evidence to support the board's findings. The brief of respondents-appellants states that no ground is seen for reversal or modification. Decision affirmed, with costs to respondents-appellants. Herlihy, P.J., Reynolds, Greenblott, Cooke and Simons, JJ., concur.
