May 7, 1952.

Appeal from Workmen's Compensation Board.

Present — Foster, P.J., Heffernan, Brewster, Bergan and Coon, JJ.


Credible evidence and legitimate inferences therefrom support the board's findings to the effect that the cerebral hemorrhage which caused claimant's disability had its genesis in an accidentally occasioned heavy weight carrying incident which he experienced in the course of employment and arose out of it. The board's decision on the questions of fact presented by the record is final. (Workmen's Compensation Law, § 20.) Nothing is shown to disturb the discretion which was exercised in permitting a late filing of the claim. Decision and award unanimously affirmed, with costs to the Workmen's Compensation Board.
