Respondent, who was admitted as an attorney in this State at the March 1960 Term of this court, in answer to petitions of the New York State Bar Association containing charges of professional misconduct, has filed an affidavit in which he states that he cannot successfully defend all of said charges and requests acceptance of his resignation as an attorney, revocation of his license to practice law and the striking of his name from the roll of attorneys. Consideration of respondent's application to resign was deferred pending an investigation by the Bar Association of the circumstances surrounding respondent's law practice and the consequences acceptance of the resignation would have upon the public generally and upon respondent's clients or former clients in particular. After investigation, the Bar Association has recommended acceptance of respondent's resignation. Under all the circumstances, respondent's application is granted; his resignation accepted; and his name is directed to be stricken from the roll of attorneys and counselors at law. Herlihy, P.J., Reynolds, Greenblott and Cooke, JJ., concur; Aulisi, J., not voting.
