Matter of Michigan Furniture Co., Inc. v. Selkowe

Appellate Division of the Supreme Court of New York, First Department
Oct 2, 1951
279 App. Div. 552 (N.Y. App. Div. 1951)

Opinion

October 2, 1951.

Present — Peck, P.J., Glennon, Dore, Cohn and Shientag, JJ.

Order unanimously modified insofar as to refer to an Official Referee to hear and report to Special Term upon determination of respondent's claimed lien and, as so modified, affirmed, with $20 costs and disbursements to the appellants. It does not appear that the respondent withdrew as attorney without just cause. By reason of the attitude of the petitioners, we believe there was justification for respondent's determination not to continue as attorney. Settle order on notice.
