Matter of Metzik

Appellate Division of the Supreme Court of New York, Second Department
Dec 30, 1942
265 App. Div. 969 (N.Y. App. Div. 1942)

Opinion

December 30, 1942.

Appeal by the Administrator of Veterans' Affairs from so much of an order judicially settling the accounts of the deceased committee of the incompetent as allows the attorney for the accounting administratrix the sum of $1,000 for services rendered by her in connection with these proceedings, and allows $750 to the special guardian of the incompetent for his services. Order modified on the law and the facts by striking from the decretal portion thereof which directs the payment of the fees of the special guardian, the figures "$750" and inserting in lieu thereof the figures "$375;" and by striking from the decretal portion thereof which fixes the allowance to the attorney for the estate of the deceased committee, the figures "$1,000" and inserting in lieu thereof the figures "$500." As thus modified, the order in so far as appealed from is affirmed, without costs. In view of the reduced value of the estate, admitted by the attorney, the respective fees and allowance should be reduced, as indicated. Lazansky, P.J., Carswell, Johnston, Taylor and Close, JJ., concur.
