Present — Goldman, P.J., Del Vecchio, Marsh, Witmer and Gabrielli, JJ.

Resignation unanimously accepted and name stricken from roll of attorneys. Memorandum: Paul E. McNamara, Esq. was admitted to the practice of law in this Department on the 28th day of June, 1938. He became ill and was confined to the Veteran's Administration Hospital at Canandaigua, New York, for treatment. In November, 1970 he executed and duly acknowledged his resignation from the Bar of this State and requested the removal of his name from the roll of attorneys. The Director of said hospital has certified that he has examined the applicant at the hospital and finds that at the time he executed his resignation from the Bar he had mental capacity to understand the nature of his act. The resignation should be accepted.
