Matter of Markowitz v. Mack Markowitz, Inc.

Appellate Division of the Supreme Court of New York, Third Department
Jun 19, 1967
28 A.D.2d 750 (N.Y. App. Div. 1967)

Opinion

June 19, 1967

Appeal from an award granting death benefits to a widow. This court previously remitted the matter to the Workmen's Compensation Board, determining that the findings of the board were legally insufficient. (See Matter of Markowitz v. Mack Markowitz, Inc., 22 A.D.2d 1001.) On review of the present record we determine that there is substantial evidence to sustain the finding of the board. Decision affirmed, with costs to the Workmen's Compensation Board. Gibson, P.J., Herlihy, Reynolds, Staley, Jr., and Gabrielli, JJ., concur in memorandum by Herlihy, J.
