In a proceeding under section 330 of the Election Law, to direct the Village Clerk of the Village of Ardsley, County of Westchester, to accept and file nunc pro tunc a certificate of declination for the office of Village Trustee, which had been filed on March 7, 1962, the Village Clerk appeals from an order of the Supreme Court, Westchester County dated March 15, 1962, which granted petitioner's application and ordered said Village Clerk to accept and file the certificate of declination of petitioner nunc pro tunc as of March 2, 1962. Order affirmed, without costs. No opinion. Ughetta, Acting P.J., Kleinfeld, Christ, Hill and Rabin, JJ., concur.
