Sidney A. Littman, an attorney and counselor at law who was admitted to practice as such by this court on December 23, 1942, has submitted to this court his letter dated January 20, 1971 in which he states that he thereby resigns as a member of the Bar of the State of New York, but requests permission to conclude certain real estate sales. On April 17, 1969, after trial in the United States District Court, Southern District of New York, Mr. Littman was found guilty of various felonies upon all nine counts of the indictment; and on September 9, 1969 he was sentenced by that court as follows: Count 1 — conspiracy to commit an offense, i.e., fraudulently to obtain money from others and to use interstate wire communications and the mails (U.S. Code, tit. 18, § 371); Count 2 — using facilities in interstate commerce with intent to promote extortion (§ 1952); Counts 3 to 7, inclusive — using interstate wire communications to defraud others (§ 1343); and Counts 8 and 9 — using the mails to defraud others (§ 1341). The sentences were six months' incarceration on Count 1; and concurrent terms of three and one-half years on each of the other counts, but with execution of these sentences suspended and with probation for three years, to commence at the expiration of the six-month term imposed on Count 1. The judgment of conviction was affirmed ( United States v. Littman, 421 F.2d 981) and a petition for a writ of certiorari was denied by the Supreme Court of the United States ( Littman v. United States, 400 U.S. 991). Under the circumstances herein, Mr. Littman's resignation as a member of the Bar is accepted and directed to be filed; and it is ordered that his name be struck from the roll of attorneys and counselors at law, effective April 1, 1971.
