Opinion

October 3, 1949.

Present — Peck, P.J., Dore, Cohn, Callahan and Shientag, JJ. [See 276 App. Div. 757.]

Order unanimously affirmed, with one bill of $20 costs and disbursements to the defendants-respondents and intervener-defendant-respondent George Blumental. We think the determination is correct on the merits as well as on the ground that the proceeding was barred by the Statute of Limitations.
