Appellate Division of the Supreme Court of New York, Second Department
Nov 28, 2000
(N.Y. App. Div. Nov. 28, 2000)

Opinion

Submitted October 25, 2000

November 28, 2000.

In a proceeding pursuant to Court of Claims Act § 10(6) for leave to file a late claim, the claimant appeals, as limited by her brief, from so much of an order of the Court of Claims (Lebous, J.), dated December 13, 1999, as denied her application.

Ballon Stoll Bader Nadler, P.C., New York, N.Y. (Nancy Zecca of counsel), for appellant.

Eliot Spitzer, Attorney-General, Albany, N.Y. (Peter G. Crary and Julie M. Sheridan of counsel), for respondent.

Before: GUY JAMES MANGANO, P.J., SONDRA MILLER, LEO F. McGINITY, DANIEL F. LUCIANO, NANCY E. SMITH, JJ.

DECISION ORDER

ORDERED that the order is affirmed insofar as appealed from, with costs.

We agree with the Court of Claims that the claimant's application was not timely (see, Court of Claims Act §§ 10, [6]; CPLR 213).
