Opinion

February 25, 1952.

Order denying permission to appellant to settle the record without printing certain exhibits, etc., modified by providing that in the event the parties cannot agree on a summary of any of the exhibits, that if such exhibits were merely marked for identification, or are checkbooks, or concern checkbooks, they need not be printed. As so modified, the order is affirmed, without costs. The originals of such exhibits must be handed up on the argument of the main appeal. Carswell, Acting P.J., Johnston, Adel, Wenzel and MacCrate, JJ., concur.
