MEMORANDUM OPINION


K.W., a juvenile, filed a notice of appeal, but a brief was not filed. On January 21, 2010, we notified the parties that the brief had not been filed and warned that failure to file a brief could result in a dismissal of the appeal for want of prosecution. K.W. did not request additional time. K.W.'s attorney filed a motion to withdraw the notice of appeal and dismiss the appeal. The motion was not signed by K.W. or her mother. K.W.'s attorney filed a letter stating she had spoken with K.W. and her mother by telephone, and that although they wished to dismiss the appeal, counsel had been unable to obtain their signatures. In the absence of a brief assigning error for appellate review, and considering counsel's explanation, we dismiss the appeal for want of prosecution. See TEX. R. APP. P. 38.8(a)(1); TEX. R. APP. P. 42.3(b).

APPEAL DISMISSED.
