Opinion
March 31, 1966
Order entered June 16, 1965 unanimously modified, on the law and on the facts, by deleting the allowance to the committee for legal services and reducing to $150 the allowance to the guardian ad litem, and, as so modified, affirmed, without costs or disbursements. Matter of Erlandsen ( 265 N.Y. 155) makes it plain that added compensation for legal services is warranted only when such services are found to be extraordinary or uncommon in character. (See, also, Matter of Townsend, 24 A.D.2d 93; Matter of Richter, 282 App. Div. 103.) We do not find the services of the committee to be in this category. After reviewing the services of the guardian ad litem, we are of the opinion that the award therefor is excessive.
