Present — Close, P.J., Hagarty, Carswell, Johnston and Adel, JJ.


Motion to confirm the report of Honorable Charles J. Dodd, Official Referee, in a disciplinary proceeding. The proof before the referee warranted the conclusion that the respondent had been guilty of conduct prejudicial to the administration of justice. (Judiciary Law, § 88, subd. 2.) The court confirms the report of the Official Referee, except as to the punishment to be imposed. The misconduct of the respondent justifies suspension from the practice of the law, which the court fixes at a period of three years. The respondent is suspended from the practice of the law for a period of three years, beginning September 1, 1943.
