Appeal from the Onondaga Special Term.

Present — Goldman, P.J., Del Vecchio, Witmer, Moule and Henry, JJ.


Appeal unanimously dismissed as moot, without costs, the parties having stipulated that the proceeding was discontinued. If we were to reach the merits of the appeal we would reverse the judgment appealed from.
