Matter of Jean v. Jude

Appellate Division of the Supreme Court of New York, Third Department
Mar 16, 1971
36 A.D.2d 790 (N.Y. App. Div. 1971)

Opinion

March 16, 1971

Appeal from an order of the Family Court, St. Lawrence County, entered January 30, 1970, which adjudged appellant to be the father of respondent's child. The Family Court in this paternity proceeding has decided questions of credibility and has found that the respondent proved to its entire satisfaction that the appellant is the father of the child. In our opinion the evidence in this proceeding was sufficient to create a genuine belief in the mind of the trier of the facts that appellant is the father of the child ( Matter of Patricia "E" v. Claude "F", 33 A.D.2d 870; Matter of Gray v. Rose, 30 A.D.2d 138). Order affirmed, with costs. Herlihy, P.J., Reynolds, Staley, Jr., Sweeney and Simons, JJ., concur.
