Appeal from the Family Court, Bronx County (Alma Cordova, J.).


The finding of neglect is supported by a preponderance of the evidence, showing that appellant exposed the children to domestic violence and subjected them to excessive corporal punishment (Matter of Lonell J., 242 A.D.2d 58, 62; Matter of Shawn BB., 239 A.D.2d 678). Appellant was not deprived of due process by the co-respondent's statement taken by the court in his absence, there being no indication that the court considered such statement in making the finding of neglect, or that appellant was otherwise prejudiced thereby.
