Matter of Isaacson v. Deepdale Gardens Corp.

Appellate Division of the Supreme Court of New York, Second Department
Jun 5, 1967
28 A.D.2d 684 (N.Y. App. Div. 1967)

Opinion

June 5, 1967

Order of the Supreme Court, Queens County, dated September 20, 1966, reversed, with $10 costs and disbursements, and plaintiff's motion granted in its entirety. The amended complaint and bill of particulars shall be served within 20 days after entry of the order hereon. In our opinion, the affidavits by plaintiff, his attorney and his physicians, all submitted in support of the motion to increase the ad damnum, to amend the bill of particulars and to transfer the action from the Civil Court of the City of New York to the Supreme Court are sufficient to warrant the granting of the application. Beldock, P.J., Christ, Rabin, Benjamin and Munder, JJ., concur.
