Appeal from Workmen's Compensation Board.
Present — Foster, P.J., Heffernan, Brewster, Bergan and Coon, JJ.
The employer was engaged in the business of selling automobiles. Its salesroom and service station were located in Schenectady. The decedent worked for the employer in the capacity of a salesman. The board found that on August 2, 1947, while decedent was engaged in the regular course of his employment and while demonstrating an automobile on a public highway in the county of Saratoga, the car left the road and overturned, as a result of which decedent sustained injuries which caused his death on August 3, 1947. The board also found that the injuries sustained by the decedent were accidental injuries and arose out of and in the course of his employment. The proof sustains the findings. Award unanimously affirmed, with costs to the Workmen's Compensation Board.
