Matter of Holst v. Abbate

Appellate Division of the Supreme Court of New York, Third Department
Feb 8, 1966
25 A.D.2d 577 (N.Y. App. Div. 1966)

Opinion

February 8, 1966

We find involved only issues of fact and credibility which the board could properly resolve as it did and which are not subject to our review since the board's determinations are supported by substantial evidence (Workmen's Compensation Law, § 23). Decision affirmed, with costs to the Workmen's Compensation Board. Gibson, P.J., Herlihy, Taylor and Aulisi, JJ., concur.
