Decree reversed on the law and matter remitted to the Surrogate's Court with directions to issue letters of administration to appellant Ernest H. Davis, without costs of this appeal to any party, on the authority of Williams v. North Carolina ( 317 U.S. 287). All concur, except Harris, J., who dissents and votes for affirmance. (The decree appoints an administratrix of decedent's estate and denies a cross-application for letters of administration.)
