Matter of Hansen v. State Liquor Authority

Court of Appeals of the State of New York
Mar 31, 1981
53 N.Y.2d 693 (N.Y. 1981)

Opinion

Argued February 17, 1981

Decided March 31, 1981

Appeal from the Appellate Division of the Supreme Court in the Third Judicial Department, LEONARD A. WEISS, J.

Monroe I. Katcher, II, for appellant. Leslie W. Trebby and Warren B. Pesetsky for respondents.

Order affirmed, with costs. On the record here, we cannot say that the determination of the State Liquor Authority, that public convenience and advantage would not be promoted by granting the appellant's application, was arbitrary or capricious, much less irrational (see Matter of Mandee Liqs. v Roth, 57 A.D.2d 961, affd 44 N.Y.2d 653).

Concur: Chief Judge COOKE and Judges JASEN, GABRIELLI, JONES, WACHTLER, FUCHSBERG and MEYER.
