DISCIPLINARY MATTERS

AMENDED ORDER

This Court having heard argument on July 7, 1981, on an order to show cause why the temporary suspension of J. Alan Gumbs of Perth Amboy, imposed by Order of this Court dated June 24, 1981, should not be continued pending the final disposition of ethics complaints against him and good cause appearing;

It is ORDERED that the temporary suspension of J. Alan Gumbs continue pending the final disposition of the ethics complaints against him and until further Order of this Court; and it is further

ORDERED that respondent continue to be restrained and enjoined from practicing law during the period of his suspension and continue to comply with the Regulations of the Disciplinary Review Board governing suspended, disbarred and resigned attorneys; and it is further

ORDERED that the Division of Ethics and Professional Services take appropriate action to gain possession and control of the legal files and records of J. Alan Gumbs wherever situate pursuant to R. 1:20-5(b), and to that end Joseph M. Nolan, Esquire, is hereby appointed custodial receiver for said legal files and records; and it is further

ORDERED that all funds presently existing in any N.J. banking institution and any safe deposit box located within said institution maintained by J. Alan Gumbs, pursuant to R. 1:21-6, relating to his practice of law shall be transferred into custody and control of the custodial receiver, Joseph M. Nolan, Esquire who shall place any monies so received into an interest bearing trust account. The custodial receiver is empowered to make such disbursement as are necessary to further the orderly administration of the receivership for the law practice of J. Alan Gumbs; and it is further

ORDERED that the custodial receiver is authorized and directed to apply to the Superior Court, Chancery Division, Bergen County, for an order defining and clarifying his rights and responsibilities as a custodial receiver pursuant to R. 1:28-8. Such application shall be on notice to and with the consent of Colette A. Coolbaugh, Assistant Director, Division of Ethics and Professional Services; and it is further

ORDERED that all further applications including approval of accountings concerning this custodial receivership shall be made to the Superior Court, Chancery Division, Bergen County.
