Matter of Greenwald v. Board of Education

Court of Appeals of the State of New York
Oct 21, 1982
443 N.E.2d 489 (N.Y. 1982)

Opinion

Argued October 12, 1982

Decided October 21, 1982

Appeal from the Supreme Court, ROBERT J. STOLARIK, J.

Stephen A. Perelson and Mark C. Rushfield for appellants.

Ernest Allen Cohen, David Greenberg, Seth Rosner, Allen B. Breslow, Carl Wanderman and Kathryn Rooney for respondents.

Janet Axelrod, Robert D. Clearfield and Deborah A. Watarz for Sheri Alpert and others, intervenors-respondents.

Judgments appealed from and order of the Appellate Division brought up for review affirmed, with costs. Appellants are not entitled to the relief they seek on this appeal, inasmuch as that relief was not requested and they expressly elected not to appeal "from that part of the order and judgment [BEISHEIM, JR., J., dated Sept. 14, 1977] reinstating them to teaching positions as of June 30, 1976".

Concur: Chief Judge COOKE and Judges JASEN, GABRIELLI, JONES, WACHTLER, FUCHSBERG and MEYER.
