In a proceeding under article 78 of the Civil Practice Act to review a determination of the Comptroller of Suffolk County whereby he refused to pay petitioner certain unpaid back salary, and to compel the payment thereof, the said Comptroller and the Suffolk County Civil Service Commission appeal from so much of an order of the Supreme Court, Suffolk County, dated and entered September 28, 1961, as annulled the determination, directed them to pay such salary to petitioner, and further directed them to perform the ministerial functions necessary to effectuate such payment. Order insofar as appealed from affirmed, without costs. No opinion. Ughetta, Acting P.J., Christ, Brennan, Hill and Rabin, JJ., concur.
